Recommendation: Adopt A Resolution Conditionally Approving A Final Map For Tract No. 8658, Located At 8750 Mountain Boulevard (Oak Knoll Project Phase 1 Parcel 7), For A Twenty-Eight Lot Subdivision As Part Of Property Owned By Oak Knoll Venture Acquisition, LLC; And Adopting Appropriate California Environmental Quality Act Findings
The Oak Knoll development violated the mitigation measures for Oakland star tulip. The EIR required at least 50 percent of the 723 plants be salvaged and placed "in an area designated for open space preservation." There is no conservation easement to protect the relocated plants and the last survey showed only 31 had survived being moved. This makes the mitigation measure unfeasible, even thought the FEIR claimed it was feasible. There should be no approvals until there is the mitigation for impacts to Oakland star tulip.
