5.7 25-0283 Subject: Amending L/SLBE Program Certification Requirements

Recommendation: Adopt An Ordinance Amending Oakland's Local And Small Local Business Enterprise (L/SLBE) Program (Ordinance No. 13814 C.M.S.) To Amend Certification Requirements In Response To The Needs Of Oakland's Business Community, Including But Not Limited To (1) Removal Of Headquarter Requirements; (2) Modification Of The Definition Of "Substantial Presence"; And (3) Clarifying Amendments For Program Administration, As Set Forth In Exhibit 1 Attached Hereto
We request that council not move forward with removing the local headquarter requirement in Oakland’s Local And Small Local Business Enterprise (L/SLBE) Program (Ordinance No. 13814 C.M.S.). The reason why staff keeps recommending to waive the local certification process and competative bidding is because some city staff use NIGP when seraching for services. The ISupplier system that is set up to support local certified firms does not support NIGP codes and certified firms are only able to use NAICS codes. It is city staff practice to search for services using codes that local businesses do not know about and/or are unable to put on ISupplier. We request that City Council do their due diligence and ensure city staff is following to correct procedure prior to allowing larger businesses to compete with local small qualified Oakland firms. This is not in the best interest of our local businesses and residences. In order to strengthen our local economy we must due what is inthe best interest of our small businesses.
